BIRMINGHAM, Ala. (WIAT) – A New Year’s Day shooting has been ruled as justifiable by the Jefferson County District Attorney’s Office.
Desmond Bias, 36, was shot and killed on Jan. 1 around 1:30 a.m. on Wesley Avenue.
Officers responded to reports of a person shot and found Bias lying in the road suffering from a gunshot wound.
He was pronounced dead at the scene.
Investigators with the Birmingham Police Department say there was a domestic altercation between two couples. The altercation involved Bias, his wife, the shooter and his wife.
The Jefferson County District Attorney’s Office determined there was no need to file charges against the shooter because he was merely defending himself.
